Introduction
Inner Peak AI, Inc. (“Inner Peak”, “us”, “we”, or “our”) is committed to protecting and respecting your privacy. This privacy policy applies to and describes how we collect, store, use, and share personal data about you through our software, website, mobile application, documentation, and related services (together, the “Services”). References to “you” means the person whose personal data we collect, use, and process. We will manage your personal data only as described below and consistent with applicable laws. By using the Services, you acknowledge that you have read and understand this privacy policy.
Student Data and Applicable Laws
When the Services are provided through a school or school district, student data may constitute “education records” under the Family Educational Rights and Privacy Act (FERPA). In those circumstances, Inner Peak acts as a “school official” with a “legitimate educational interest” as those terms are defined under FERPA. Inner Peak uses student data only for the purposes authorized by the school and does not redisclose personally identifiable information from education records except as permitted under FERPA.
For students under 13, Inner Peak relies on the school’s consent on behalf of parents in accordance with the Children’s Online Privacy Protection Act (COPPA). Inner Peak collects, uses, and retains personal information from students under 13 only for the educational purposes authorized by the school.

If you wish for any of the data you input to be deleted, you may either delete your account by going to your account settings in the app, scrolling to the bottom, and selecting “delete account” or you may email us directly at support@innerpeak.ai with your request. We will delete your data within two weeks of receiving your request.

You decide how much or how little you are comfortable sharing. If you do not provide us with certain personal data, some of the Services may not work as intended. We use your data only for the purpose of providing and improving the Services as described in this policy.

Inner Peak sometimes detects an input that might indicate you need more support than we can provide. Inner Peak is not a crisis service, and does not provide mental health care or crisis care. If we detect that you may need more support than we can provide, we will administer an industry-standard suicidality screening tool. If you are deemed to be moderate or high risk of suicide or risk of harm to others, Inner Peak may take certain actions to provide you additional support (such actions may include connecting you with a suicide hotline, sending a notification to school administrators, and/or sending a notification to your emergency contact to check in).

Note on our social media pages
Inner Peak may maintain social media pages. Any personal data you share on the public sections of our social media pages is public and, unless otherwise required by applicable laws, is not covered by this privacy policy. Please exercise caution before sharing information that may identify you on the public sections of our social media pages. In addition, our Services may contain social media buttons to “Share Inner Peak.” Use of, or sharing personal data, with a social media service will also be subject to the social media service’s terms of service and privacy policy.
Do You Share My Personal Data?
We do not share your personal data with third parties except as outlined below. We maintain total user privacy in the free text you write, including your journal entries and your messages with Peak’s AI coaches / interactive journal. When the Services are provided through a school, your multiple-choice check-in responses may be shared with designated school personnel as described below.
Service providers
We use third party service providers that help us provide our Services. These third parties may have limited and controlled access to personal data in connection with the services they provide such as hosting or customer service. The use of personal data by service providers outside of agreed-upon service they provide is prohibited.
We will not share:
Your conversational interactions with Inner Peak, like what you write or your path through a conversation, unless you give us your consent to do so.

De-identified and/or aggregated data about how Inner Peak users use the app and its effectiveness
Teachers, counselors, and school administrators
We will not share:
The free text you write, like your messages to our AI coaches or your journal entries, in any form that identifies you, unless (i) you have given your permission or (ii) you indicate that you or someone else is in danger, in which case we may reach out to your Emergency Contact, the appropriate point of contact at your school, and / or law enforcement.
We often share:
Your responses to the multiple-choice questions in your check-ins, including which options you individually selected; and de-identified and/or aggregated data about how Inner Peak users use the app and its effectiveness
Your interactions with third-party services
Our Services may link to third parties, like helplines or other resources. Any information shared with or otherwise collected by third parties is subject to the third party’s terms and privacy policy. We are not responsible for the processing of personal data by third parties relevant to these resources.
De-identified and/or aggregated data
We may use your personal data to create de-identified and/or aggregated data, like approximate location information, information about the device you use to access our Services, information about conversational trends, or other analyses we create. De-identified and/or aggregated data is not personal data and we may use and share this data as permitted by applicable law, such as with academic partners. We never share your transcripts or journal entries in a form that can be tied back to you without your consent. We may share themes drawn from this free text, including with your school, only in de-identified and/or aggregated form.
Disclosures to protect us or others
We may access, preserve, and disclose any personal data we store associated with you to external parties if we, in good faith, believe doing so is required or appropriate to:
Comply with law enforcement or national security requests and legal process, such as court order or subpoena;
Protect you, our, or others’ rights, property, or safety;
Enforce our policies or contracts; or
Assist with an investigation or prosecution of suspected or actual illegal activity
Data Retention and Deletion:
We retain your personal data only for as long as necessary to provide the Services and fulfill the purposes described in this policy. When the Services are provided through a school or school district, we will delete or de-identify student data within 60 days of receiving a deletion request from the school or within 60 days after the agreement between Inner Peak and the school expires or terminates, whichever is earlier, unless retention is required by law. You may also delete your account and associated data at any time through your account settings or by contacting support@innerpeak.ai.
Lawful Basis:
The lawful basis for processing personal data under this policy is: (1) performance of a contract (providing the Services you or your school have requested); (2) legitimate interest (improving the Services, ensuring safety); and (3) consent (where required by applicable law, including parental or school consent for students under 13 under COPPA). When the Services are provided through a school, the school’s authorization under FERPA and, for students under 13, the school’s consent under COPPA, serve as the legal basis for the processing of student data as described in this policy.
